Any Insurance  Broker can sell you an insurance policy,  but if they don't specialize in  Condominium Corporations, that risk is passed on to  the Board

of Directors and owners. 


Based on the By-laws, the Board is ultimately responsible to place and maintain the insurance,

so who will be sued when something goes wrong?

 


By-laws are the operating manual for Condominium Corporations, so the less they contain the more likely for there  to be problems.   The Condominium Property Act  is silent on certain aspects of the claim process, so if your By-laws are out of date, which many are, then problems are likely to arise when a claim occurs.  


Most Boards are not aware of this until a claim occurs, because their Insurance Broker/Agent does not specialize in Condominium Insurance and failed to advise the Board of Directors to update the By-laws.
